General Terms & Conditions

1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts between meet mariah Fotografie (hereinafter referred to as the “Photographer”) and its clients regarding photographic services in the field of event photography, as well as the purchase of digital fine art photographs via the online shop. Any differing terms and conditions of the client shall not be recognized unless the Photographer expressly agrees to their validity in writing.
2. Contracting Party
The contracting party is: meet mariah Fotografie Frankfurt am Main, Germany
3. Conclusion of Contract
3.1 Event Photography
A contract for photographic services is concluded once an offer from the Photographer has been accepted in writing (by email or booking confirmation).
3.2 Fine Art Shop (Digital Content)
The photographs presented in the online shop do not constitute a legally binding offer. By completing the ordering process, the client submits a binding offer to purchase a digital image. The contract is concluded upon order confirmation.
4. Services
4.1 Event Photography
Photographic services in the field of event photography are offered exclusively as package services. The specific scope of services results from the booked package and the individual offer. Typical components of a package may include:
Photographic coverage of the event for a defined period Selection and professional post-processing of the images in the style of meet mariah Fotografie Provision of the final images in digital form
Granting of the agreed usage rights Additional services (e.g. extension of coverage time, additional image editing, extended usage rights) are not included in the packages and will be charged separately.
4.2 Digital Fine Art Images
The products offered are digital image files available for download. No physical products will be shipped.
5. Prices and Payment Terms
Prices for event photography are based on the package prices displayed on the website or on individually prepared offers. All prices are stated in euros. Due to the application of the small business regulation pursuant to § 19 UStG (German VAT Act), no VAT is shown (if applicable).
Payments for event photography are made in accordance with the payment terms agreed in the offer. Additional services or extensions will be charged separately.
Digital products from the Fine Art Shop must be paid in full prior to download.
6. Usage Rights
6.1 Event Photography
Upon full payment, the client receives — depending on the agreed offer — a non-exclusive, unlimited right of use in terms of time and territory for the delivered images. Use is permitted solely within the agreed purpose. Passing the images on to third parties or editing them is only permitted with the Photographer’s explicit consent, unless otherwise agreed in the offer. Copyright always remains with the Photographer.
6.2 Fine Art Shop
By purchasing a digital image, the client acquires a non-exclusive right of use for private or decorative purposes. Commercial use, reproduction, resale, or transfer to third parties is not permitted unless a separate license has been purchased. Copyright always remains with the Photographer.
7. Right of Withdrawal
7.1 Services (Event Photography)
The right of withdrawal is governed by statutory provisions. There is no right of withdrawal if the service has been fully rendered.
7.2 Digital Content
For digital content, the right of withdrawal expires in accordance with § 356 para. 5 BGB once the download has begun and the client has expressly agreed to this.
8. Cancellation and Non-Performance (Event Photography)
Bookings for event photography are based on the agreed package prices. Cancellation by the client is possible up to a date specified in the offer. If no separate regulation is agreed, the following cancellation fees apply: Up to 14 days before the event: free of charge Less than 7 days before the event: 100% of the agreed package price.
In the event that the Photographer is unable to perform due to force majeure (e.g. illness, accident), a replacement date will be offered.
9. Data Protection
Personal data is processed in accordance with the privacy policy of meet mariah Fotografie.
10. Final Provisions
The law of the Federal Republic of Germany shall apply. The place of jurisdiction is — insofar as legally permissible — Frankfurt am Main.
