Terms and Conditions (GTC)

§ 1. General
The following General Terms and Conditions (GTC) in the version available on the website at the time of the order apply exclusively to the business relationships between the webshop owner specified in the imprint - hereinafter referred to as photographer (meet mariah) - and the customer.

§ 2 Content of contract
The customer commissions the photographer to produce prints and other media from digital photo source material, in particular posters with a frame. However, the rights to the original work and the digital photo data remain entirely with meet mariah. The contract is concluded when the order placed by the customer is accepted by the photographer by separate email or by sending the goods. The information on the website merely represents an invitation to the customer to submit an offer.

§ 3 Appointment

If a prior appointment between meet mariah and the customer cannot be kept by the customer, this should be communicated as early as possible. Otherwise the following cancellation fees apply:

3.1. Appointment cancellation / withdrawal from the appointment
For 7 working days before the agreed date of service provision, the cancellation fee is 30% of the agreed service costs. Less than 72 hours before the agreed date of service provision, the cancellation fee is 50% of the agreed service costs. If the customer does not appear, the service is deemed to have been rendered and 100% of the agreed service costs are due (plus incurred expenses/travel costs).

3.2. rescheduling
If the agreed appointment is postponed in a timely manner, a loss of work compensation of 25% of the agreed service costs (gross) will be incurred if notification is made less than 72 hours before the service is provided. If the appointment is made up for within 4 weeks, this compensation will not apply. Agreed appointments can be postponed a maximum of 2 times. After that, the service is deemed to have been rendered.

3.3. late at the appointment
If the customer is late for the appointment, the delay will be deducted from the agreed consultation time or charged as a surcharge at the regular hourly rate (30 minutes 25 euros, 60 minutes 50 euros).

 

§4 Time billing
If, at the customer's request, the use of services exceeds the assigned time quota, the additional time required will be billed in half-hour increments. 15 minutes overdraft are included as a gesture of goodwill. Time overruns of 20-30 minutes are considered a flat rate of 1/2 hour (30 euros), anything beyond that is considered an extra full hour (50 euros).

 

§ 5 Pricing

The goods are delivered at the prices stated on the photographer's website on the day the order is placed by the customer.

All products in the Wand Art Store are not free shipping, the Versand price is listed per product.

The stated invoice price is a final price, according to §19 UStG no sales tax is charged and is therefore not shown.

Shipping costs  in the online shop for print or framed products are free of charge within Germany.

§ 6 Right of Withdrawal
The customer has the right to withdraw from this contract in writing by email within 14 days without giving reasons to:kontakt@meetmariah.deto revoke. The period is 14 days from the day on which the customer took possession of the goods.

 

§ 7 Terms of payment

Payment is made by bank transfer within 14 working days to the account specified on the invoice. Or by direct payment with PayPal. If the customer defaults in payment after the invoice date has expired, a friendly payment reminder will be sent with a new payment target. If the customer does not pay the outstanding amount after the payment reminder has expired, a reminder fee of 5 euros will be due in addition to the invoice amount.

§ 8 Warranty for Defects
The goods must be checked for completeness and defects immediately upon receipt. Later complaints about incomplete or insufficient delivery or service cannot be considered. If there is a defect in the goods, the customer is entitled to choose whether to remedy the defect or to deliver a new item free of defects. However, the photographer may refuse the selected supplementary performance if this can only be carried out with disproportionate costs and if the other type of supplementary performance would not entail any significant disadvantages for the customer. If the supplementary performance fails, the customer can choose to withdraw from the contract or reduce the purchase price. A special quality of the goods to be delivered is not agreed. The delivered goods are defective if they do not meet the technical standard of digital photo development and processing. Color deviations between the products and the image files displayed differently on different screens cannot be technically avoided and are therefore not defects. There is also no defect if, despite a warning, the customer orders a format or photo product for which the original image file does not have the optimum resolution and the image quality is impaired as a result (e.g. pixelation, blurring).

§ 9 Shipping
Means of transport are determined by the photographer or his vicarious agents, unless otherwise expressly agreed. The photographer is entitled to make partial deliveries. Unless otherwise agreed, large products are delivered "free to the curb", i.e. to the public curb closest to the delivery address. The costs are calculated according to the price information on the Wand Art Shop page. Delays in delivery do not justify refusal of acceptance. Deliveries that do not arrive must be reported within 14 working days of the order being placed. If the customer fails to do so, the goods are deemed to have been successfully delivered.

§ 10 data protection
For order processing, the customer's personal data is collected by the photographer. Prior to the conclusion of the contract, the customer gave his separate consent to the collection, processing and use of his personal data. The collection, processing and use of personal data takes place exclusively for the purposes specified in the data protection declaration. The collection, processing and use of the customer's personal data takes place in compliance with the General Data Protection Regulation (GDPR) and the Teleservices Data Protection Act. All data will be treated confidentially. If the customer revokes his consent for the future, the photographer undertakes to delete the personal data immediately, unless the order processing has not yet been completed, s.Data protection.

§ 11 Jurisdiction
In legal disputes in connection with this business relationship, German law applies exclusively. Place of performance is Frankfurt a. Main and for all contracts Frankfurt a. Main agreed.
